PHOTO AND MEDIA WAIVER AND RELEASE FORM

For children under the age of majority in the province or territory

WARNING: THIS AGREEMENT WILL AFFECT YOUR LEGAL RIGHTS. READ IT CAREFULLY!

1. I am the Parent/Guardian of the Student and represent the Student. I am executing this photo and media waiver of privacy and personality or publicity rights and release of all legal claims relating to the commercial, promotional, or other public use of the resulting audiovisual work on behalf of the Student in my capacity as Parent/Guardian and on behalf of any legal representatives and with the intent that this Waiver and Release be binding on myself, any future legal representatives, and the Student for all purposes.
2. For the intangible value gained by the Student for their participation in the Martial Arts Activities as good and sufficient consideration, the receipt and sufficiency of which I hereby acknowledge on behalf of the Student, I hereby grant the Organization,  Jeon Eui Taekwondo, my permission to use the Student’s likeness or any other personal characteristics and private information of the Student in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without any payment or any other consideration.
3. I understand and agree that all photos will become the property of the Organization, Jeon Eui Taekwondo or any of its affiliates, successors, licensees, agents, and assigns (“Authorized Persons”), on a perpetual basis throughout the world and in any medium or format whatsoever now existing or hereafter created, and will not be returned. I hereby forever forfeit and discharge all rights of the Student’s image or likeness of their image or any other personal characteristics and private information of the Student, in any media or audiovisual form, over to the Organization unconditionally and without payment or any other consideration whatsoever.
4. I hereby irrevocably authorize the Organization, Jeon Eui Taekwondo to edit, alter, copy, exhibit, publish, or distribute these photos or videos or any other audiovisuals of any format for any lawful purposes. In addition, I waive any right to inspect or approve the finished product wherein the Student’s likeness or personal characteristics and private information appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
5. I hereby irrevocably waive all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages, and expenses, including but not limited to claims for copyright or trademark infringement, infringement of moral rights, libel, slander, defamation, invasion of any rights of privacy, intrusion upon seclusion, violation of rights of personality or publicity, physical or emotional injury or distress, or any similar claim or cause of action in tort, contract, or any other legal theory, now known or hereafter known in any jurisdiction throughout the world (collectively, "Claims"), arising directly or indirectly from the Authorized Persons' exercise of their rights under this Release and the use and exploitation of the Work, the Recording, and/or the Materials, and whether resulting in whole or in part by the negligence of Company or any other person, covenant not to make or bring any such Claim against any Authorized Persons, and forever release and discharge the Authorized Persons from liability under such Claims, and hold harmless, release, and forever discharge the Organization, Jeon Eui Taekwondo and all its Authorized Persons, from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
6. I understand that the Organization, Jeon Eui Taekwondo, is relying on this Release and will incur significant expense in reliance on this Waiver and Release, and I agree that this Waiver and Release cannot be terminated, rescinded, or modified. I waive my right to injunctive and other equitable relief in the event of a dispute with the Organization, Jeon Eui Taekwondo. I will not have the right to enjoin or interfere with the production, distribution, exploitation, advertising, or promotion of any of the recordings or media materials ever produced by the Organization, Jeon Eui Taekwondo, or its Authorized Persons.
7. I hereby do, (a) assign, transfer, and otherwise convey to Company, irrevocably and in perpetuity, throughout the universe, all of my right, title, and interest in and to, if any, the photo, media and all other recording and created materials, including all copyright and other intellectual property rights, including all registration, renewal, and reversion rights, and the right to register and sue to enforce such copyrights against infringers; and (b) irrevocably waive any and all claims I may now or hereafter have in any jurisdiction to so-called “moral rights” or rights of droit moral in the Recording and the Materials.
8. I confirm that I have had sufficient time to read and understand each term in this Photo and Media Waiver and Release Form in its entirety, and have agreed to the terms freely and voluntarily, and have consulted with the appropriate professional advisor of my choosing. I understand the terms of this Agreement in its entirety are binding on myself, the Student, any successors and assigns, and Releasees of the Organization.

BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY WAIVING SUBSTANTIAL LEGAL RIGHTS Of THE STUDENT AS WELL AS  ON MY BEHALF AND ON BEHALF OF MY AND THE STUDENT’S HEIRS, EXECUTORS, ADMINISTRATORS, LEGAL REPRESENTATIVES, ASSIGNS, SUCCESSORS, AND NEXT-OF-KIN; OUR WAIVER AND RELEASE  INCLUDES THE RIGHT TO SUE THE COMPANY AND THE RELEASEES.
