ACKNOWLEDGEMENT OF RISK AND RELEASE OF LIABILITY

For children under the Age of Majority in the Province or Territory in which the Martial Arts Activities at Whichever Premise(s) that are Provided by the Organization
WARNING: THIS AGREEMENT WILL AFFECT YOUR LEGAL RIGHTS. READ IT CAREFULLY. IF ARE ANY QUESTIONS, PLEASE CONSULT WITH THE APPROPRIATE PROFESSIONAL BEFORE SIGNING!
Every Parent/Guardian Must Read and Understand this Waiver Prior to the child Participating in Martial Arts Activities.

The following Waiver of claims, Release of liability, and Assumption of risks Agreement and all other terms of this Agreement are entered into by me on behalf of the undersigned child (the “Student”) with and for the benefit of Jeon Eui Taekwondo, its assigns, successors, directors, officers, employees, volunteers, business operators, agents and site property owners or lessees (collectively as the “Organization”). As lawful consideration for the Student being permitted by the Organization to be on the Premises and to engage in the Martial Arts Activities, I, both as the Student or the rightful Parent/Guardian of the Student, agree to all the terms and conditions set forth in this agreement (this "Agreement").

  1. I am the Parent/Guardian of the Student and am executing this waiver on behalf of the Student in my capacity as Parent/Guardian and with the intent that this waiver be binding on myself and the Student for all purposes.
  2. “Martial Arts Activities” includes but is not limited to contact and non-contact fitness activities, lessons, classes, training, use of facilities, programs and services provided to the Student by the Organization.
  3. I am aware that there are inherent and significant and permanent dangers, hazards and risks (“Risks”) associated with the participation in Martial Arts Activities. I understand that the Risks are relative to the Student’s state of fitness or health (physical, mental and emotional), and to the awareness, care and skill with which the student conducts himself, herself, or themselves while participating in Martial Arts Activities.
  4. While the Student is engaged in any Martial Arts Activities provided by the Organization, I voluntarily accept and fully assume all responsibility for all Risks and possibilities of permanent and serious illness (including contracting any highly infectious diseases or risk of exposure to any bacterial or viral diseases including but not limited to the Covid-19 or any other variants of such), personal injury, permanent disability, death, property damage or any other types of loss resulting from the Student’s participation in Martial Arts I understand that although the Organization has taken steps to reduce the Risks and increase safety measures of the Martial Arts Activities, it is not possible for the Organization to make the Martial Arts Activities completely safe. I accept these Risks and agree to the terms of this waiver even if the Organization is found to be negligent or in breach of any duty of care or any obligation to the Student in the Student’s participation in Martial Arts Activities.
  5. I confirm and promise that the Student is in good health; that the Student is not presently, nor will the Student participate while under the influence of any drug or medication or ill health or any undiagnosed or known mental or physical illness. No one affiliated with the Organization has encouraged me to enter or made any representations regarding my fitness or ability to participate.
  6. I acknowledge the Student’s obligation to always inform the nearest employee of the Organization if the Student feels any pain, discomfort, fatigue or any other symptoms the Student may suffer during or immediately after his or her participation in Martial Arts Activities. I understand that the Student may stop participating at any time, and has the right to immediately withdraw from any exercise or drill in which the conduct of any party seems beyond the scope of training, if it makes the Student anxious, fearful, or uncomfortable or which the Student believes if participating in any of the activities will be harmful to him or her.
  7. In addition to consideration given to the Organization for the Student’s participation in Martial Arts Activities, I and my heirs, next of kin, executors, administrators and assigns, as well as the Student’s heirs, next of kin, executors, administrators and assigns (collectively our “Legal Representatives”) hereby agree:
    • to expressly waive and forever release any and all claims that I, the Student or our Legal Representatives have or may in the future have against the Organization and its affiliates, and their respective officers, directors, employees, agents, representatives, shareholders, successors, and assigns (collectively as the “Releasee”); and
    • to release and forever discharge the Organization and all other Releasees from such claims of all liability for all personal injury, illness, disability, death, property damage or loss resulting from the Student’s participation in Martial Arts Activities at the designated premises due to any cause whatsoever, including but not limited to any negligence of the Organization or any other Releasee or otherwise, breach of any duty imposed by law or any statutory or other duty of care, breach of contract, or any mistake or error in judgment of the Organization.
  8. I, the Student, and any of our legal representatives all agree to be liable for and to defend, indemnify, and hold harmless the Organization from all losses, damages, liabilities, deficiencies, actions, proceedings, judgments, settlements, interests, awards, penalties, fines, claims, damages, costs or expenses of whatever kind, or demands including court costs, costs of pursuing any insurance providers, and costs on a solicitor and own client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with the Student’s participation in Martial Arts Activities with the Organization or whatsoever kind arising out of or resulting from any claim of a third party related to the Martial Arts Activity or the Student being on the Premises.
  9. I, the Student, and any of our legal representatives all agree that this waiver and all terms contained within are governed by the laws of the Province or Territory in which the Student is participating in Martial Arts I hereby irrevocably submit to the jurisdiction of the courts of that Province or Territory. We also agree that this Agreement constitutes the entire agreement between the parties and supersedes all prior understandings and representations and warranties, written and oral, with respect to this subject matter between the parties. This agreement is binding on and shall inure to the benefit of the Organization and I and our respective successors and assigns.
  10. I, the Student, and any of our legal representatives all confirm that we have had sufficient time to read and understand each term in this waiver in its entirety, and have agreed to the terms freely and voluntarily, and have consulted with the appropriate professional advisor of my choosing. . I understand the terms of this Agreement in its entirety are binding on myself, the Student, any successors and assigns, including any legal representatives, and Releasees of the Organization.
BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY WAIVING SUBSTANTIAL LEGAL RIGHTS (ON MY BEHALF AND ON BEHALF OF MY HEIRS, EXECUTORS, ADMINISTRATORS, AND NEXT-OF-KIN), INCLUDING THE RIGHT TO SUE THE COMPANY AND THE RELEASEES.
